Terms of Service

PRGRM is operated by Cody Marshall, based in California, United States. These Terms apply to your use of PRGRM at getprgrm.com and its program-building tools. Please read them before using the service. If you do not agree, do not use PRGRM. You must be legally able to enter into these Terms, or use the service with the consent and supervision of a parent or legal guardian where permitted by law. PRGRM is not intended for children under 13.

PRGRM is a beta service for creating, saving, analyzing, previewing, and exporting training programs. Features may change, contain errors, or be temporarily unavailable. Participation does not guarantee any future feature, continued beta access, or future pricing. Any paid offering will have its price and conditions disclosed separately before you agree to pay.

Provide accurate account information, protect your sign-in credentials, and tell us if you suspect unauthorized access. You are responsible for activity you authorize through your account. Anonymous work is stored in this browser and can be lost when browser data is cleared or a draft is replaced. Save important work to your account and keep independent copies of important programs and exports. Beta storage and recovery cannot be guaranteed.

You retain any ownership rights you hold in programs, notes, images, branding, and other content you provide. You give PRGRM a non-exclusive permission to store, process, reproduce, and display that content only as needed to operate the service for you, including saving, analysis, preview, export, security, and support. This permission extends to service providers working on our behalf for those purposes. It does not give us permission to sell your programs or publish them for marketing without your separate permission. It ends when the content is deleted, except for limited retention described in the Privacy Policy.

Publishing unlocks the prepared files for one program and includes future publishing updates to that program at the price shown before checkout. Marketplace selling is optional. By submitting a listing, you confirm that you have reviewed its sample and creator profile, have the necessary rights to its content, and authorize PRGRM to display your creator profile and listing and deliver the reviewed files to buyers. Listings and updates are reviewed before activation. Sales require approval and a connected Stripe account that can accept payments and receive payouts; you may complete that setup later. Stripe handles account onboarding and identity verification under the terms presented during its setup. PRGRM charges a 15% platform fee, including standard payment processing, on the program price excluding separately collected tax. Estimated creator proceeds are 85% before taxes, refunds, and adjustments. The hosting and refund conditions shown before checkout also apply. Pausing a listing stops new sales; existing buyers retain their purchased access. Updates submitted for review do not replace an existing live version until approved.

A publishing purchase covers publishing one program and future updates to that same program. Hosted downloads and included TRAIN access remain available while PRGRM operates those services and your access remains active. Downloaded files may be used under the applicable program license; keep independent backups. Pausing or removing a marketplace listing stops new sales without removing existing buyers’ purchased access. For a planned shutdown of hosted access, PRGRM will provide at least 30 days’ notice and an opportunity to download files, except where legal or security restrictions prevent this.

Contact support@getprgrm.com within seven days of purchase to request a full refund of a publishing purchase or marketplace program purchase. Duplicate charges and purchases PRGRM cannot deliver will also be corrected or refunded. A full refund ends the access and license associated with that purchase; partial refunds do not automatically remove access. Refunding a creator’s publishing purchase stops new sales but does not revoke existing buyers’ purchases. Nothing in this policy limits mandatory consumer rights.

Previously exported beta files remain usable under their existing permissions. Existing saved programs will not be deleted or retroactively charged because paid publishing launches. Existing complimentary publishing access explicitly granted by PRGRM remains valid for the same program. New publishing purchases use the price disclosed before checkout. Sandbox transactions are test records and do not automatically establish paid or complimentary access.

Only upload or use content that you own or have permission to use. You are responsible for obtaining any permissions needed for client information, images, logos, and third-party materials. Avoid entering unnecessary sensitive personal or health information. You may share and use your exported programs, including with your own clients, subject to the rights of others. Exporting does not transfer ownership of PRGRM software, branding, or third-party materials to you.

PRGRM provides authoring tools and informational analysis, not medical advice, diagnosis, treatment, or individualized professional supervision. Analysis reflects the entered prescriptions and disclosed assumptions; it does not establish that a program is safe, effective, or suitable for a particular person. Review all programs, calculations, and exported documents before using or sharing them. Exercise involves risk. Coaches and users are responsible for assessing suitability and obtaining qualified guidance when needed.

Do not use PRGRM unlawfully, infringe intellectual property or privacy rights, upload malicious code, harass others, send spam, or interfere with the service. Do not attempt to access another person’s account or private programs, bypass access controls, or overload the service. These restrictions do not prevent lawful reporting, honest reviews, or good-faith feedback.

PRGRM and its licensors retain their rights in the service, software, design, and branding. These Terms permit you to use the service for its intended purpose; they do not transfer those rights. Feedback is voluntary. We may use suggestions to improve the service without an obligation to compensate you, but submitting feedback does not transfer ownership of your programs or authorize public use of your name or private messages.

Our Privacy Policy explains how we handle account information, programs, technical information, and feedback. For help with PRGRM, contact support@getprgrm.com. For personal-information access, correction, export, or deletion requests, contact privacy@getprgrm.com. Beta support is provided as available, with no guaranteed response time.

To the extent permitted by applicable law, PRGRM is provided as available, without promises that it will always be uninterrupted, error-free, or suitable for a particular purpose. To that same extent, we are not responsible for indirect or consequential losses arising from use of the service. Nothing in these Terms excludes responsibility that cannot lawfully be excluded, or limits any mandatory consumer rights or remedies you have.

You can stop using PRGRM at any time and request account deletion through privacy@getprgrm.com. We may restrict or suspend access when reasonably necessary to address abuse, security risks, legal requirements, or a material breach of these Terms. Where practicable and lawful, we will explain the reason and provide an opportunity to resolve the issue. If we discontinue the beta, we will aim to give reasonable notice and an opportunity to export your work. Planned shutdown of purchased hosted access follows the 30-day notice commitment in Hosting and purchased access. Retention and deletion are described in the Privacy Policy.

We may revise these Terms as the service develops. We will post the revised version and its effective date, and provide reasonable notice of material changes through the service or email. Where required, we will seek your agreement before changes apply. Changes do not retroactively remove rights you already have. Contact support@getprgrm.com with questions or concerns so we can try to resolve them. Nothing here prevents you from using remedies available under applicable law.
